Pet Health Plan Terms and Conditions
BACKGROUND: These Terms and Conditions, the Application Form and the Health Plan Leaflet together shall apply to the provision of the Plan by Abbeywell Veterinary Clinic of 2-3 Majestic Parade, Sandgate Road, Folkestone, Kent CT20 2BZ. These Terms are important and we strongly advise that you read through them carefully and keep them in a safe place.
- Definitions and Interpretation
1.1 In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:
“Animal” means the animal (patient) belonging to the Owner that is to be the subject of consultation and/or treatment by the Surgery;
“Owner” means the owner of an Animal (patient);
“Plan” means the Total Plan or Complete Plan; and
“Surgery” means the Abbeywell Veterinary Clinic and reference to the Surgery shall include reference to any and all staff including veterinary surgeons.
1.2 Unless the context otherwise requires, each reference in these Terms and Conditions to:
1.2.1 “these Terms and Conditions” is a reference to these Terms and Conditions and each of the Schedules as amended or supplemented at the relevant time;
1.2.2 A Clause or sub-Clause is a reference to a Clause of these Terms and Conditions; and
1.3 Any headings used in these Terms and Conditions are for convenience only and shall have no effect upon the interpretation of these Terms and Conditions.
1.4 Words imparting the singular shall include the plural and vice versa.
1.5 References to any gender shall include the other gender.
- General terms and conditions of membership
2.1 All Animals joining the Plan must be identifiable by a microchip.
2.2 Plan benefits are for each period of twelve months.
2.3 The Plan is a Direct Debit only scheme and payments are collected on behalf of the Surgery by Easy Direct Debits Limited.
2.4 The Plan and the monthly payment will be set by the Surgery at the time of joining based on the species, age and weight of the Animal.
2.5 Membership of the Plan will begin on the day that the first monthly payment is collected.
2.6 The Owner will be entitled to the benefits of Membership on the day following receipt of the first monthly direct debit payment. No benefit or discount can be given retrospectively.
2.7 Discounts can only be applied to treatments, products and services if payment is received at the time of treatment or when products or services are provided
2.8 If the Owners details change the Surgery must be informed immediately.
2.9 Failed Direct Debit payments because of a lack of available funds etc. cause a significant increase in administration costs for the Surgery. We reserve the right to charge an administration fee of £12.00 for each failed payment. This administration charge will be added to your account and the Plan will be suspended until payment has been received.
2.10 If three direct debits are returned as unpaid, the Surgery reserves the right to cancel membership.
2.11 If the membership is cancelled by the Surgery, the Owner will be liable to pay the difference in price between the monthly direct debit payments received by the Surgery and the full retail price of any products, treatments, services, benefits or discounts received by the Owner or the Animal whilst being a member of the Plan
2.12 If the membership is cancelled by the Owner, the Owner will be liable to pay the difference in price between the monthly direct debit payments received by the Surgery and the full retail price of any products, treatments, services, benefits or discounts received by the Owner or the Animal from the time of the most recent renewal anniversary of the Plan
2.13 No Plan discounts can be used or applied in conjunction with any other offer or discount that the Surgery may be promoting at the time.
2.14 Flea and worm treatments are dispensed every three months. Membership of the Plan entitles the Owner to collect Parasite treatment from the Surgery every three months. It is the Owner's responsibility to collect the appropriate flea and worm treatments when they are due.
2.15 If an Owner does not collect the appropriate treatments during the period for which they are due, the Surgery will be unable to dispense those treatments as the Plan does not allow for the ‘roll-over’ of any such treatments.
2.16 Any treatment, product or service that is not used or collected is non-transferable and non-refundable.
2.17 The flea and tick treatment currently provided for cts by the Surgery as part of the Plan is Stronghold Plus spot-on and this treatment is dispensed in boxes of three pipettes. It is understood that this treatment may change in the future.
2.18 The flea and tick treatment currently provided for dogs by the Surgery as part of the Plan is Simparica tablets and this treatment is dispensed in boxes of three tablets. It is understood that this treament may change in the future.
2.19 The worming treatment currently provided by the Surgery as part of the Plan for both cats and dogs is Milprazon. The worm treatments for both cats and dogs are dispensed according to the Animal's weight to cover a three month period. Tit is understood that this
2.20 If an Animal is entitled to an annual booster and health check, this must be administered a minimum of two weeks before the due date and upto a maximum of two weeks after the due date. The Surgery provides booster reminders by email and SMS, but it is the responsibility of the Owner to ensure the Animal receives the booster at the due date. Any additional veterinary consultations, health checks, procedures, treatment, consumables, vaccines, medication etc. are payable seperately by the Owner.
2.21 The Plan entitles the Animal to one veterinary consultation during each twelve month period. Any additional veterinary consultations, health checks, procedures, treatment, consumables, vaccines, medication etc. are payable seperately by the Owner.
2.22 If the Animal is entitled to a Wellness Blood Test at a discounted rate, this must be carried out at the time of the annual vaccination. Any additional veterinary consultations, health checks, procedures, treatment, consumables, vaccines, medication etc. are payable seperately by the Owner.
2.23 The Plan entitles the Animal to a health check with a nurse six months after the date of the annual vaccination.
2.24 The Plan entitles the Animal to a six monthly nail clip, this is carried out at the time of annual vaccination and at the six month health check with a nurse.
2.25 Membership discounts and benefits are unique to the Animal and are only applicable to treatments, products and services purchased or received for the Animal. Discounts and benefits are not applicable to any treatments, products or services purchased or received for any other animal.
2.26 We reserve the right to terminate the Plan after giving no less than one month's notice.
2.27 THE PLAN IS NOT AN INSURANCE POLICY
2.28 The Plan will be automatically renewed on an annual basis unless the Owner cancels the Plan
2.29 The Plan will be automatically renewed on the anniversary date of joining. The Owner may cancel the Plan on the anniversary date by giving not less than one months’ written notice. Any outstanding payments for treatment or benefits provided will be due and payable immediately
2.30 The Plan in non-transferable and non-refundable.
2.31 If an Owner wishes to change the payment collection date, they should contact the Surgery at least two weeks before the due collection date.
2.32 The Surgery reserves the right to review and adjust monthly fees, with any adjustment being applied in the first month following renewal. The monthly fee may also change if different weight thresholds are reached by the Animal. Should any fees need to change the Owner will be given at least fourteen days’ notice
2.33 By completing and signing the membership application form the Owner shall agree to the terms and conditions of the Plan as set out in this document.
2.34 The Surgery has an in-house complaints procedure if an Owner is unhappy with any aspect of the Plan or the veterinary care received.
- Data Protection
3.1 The Surgery will not share any data regarding the Owner or their Animal with any third parties for any reason without the prior consent or request of the Owner. The surgery reserves the right to share data regarding the Owner and their Animal in association with debt recovery.
3.2 Easy Direct Debits Limited and the Surgery will hold and use personal data regarding the Owner (as defined by the General Data Protection Regulation ) for the purpose of administering the Plan.
3.3 The Surgery and Easy Direct Debits Ltd. May record and monitor inbound and outbound telephone calls for training purposes. These calls may also be referred to in relation to any future queries.
3.4 Owners have the right to see their personal data. Please note that there may be a charge for this. - Complaints and Standards
The Surgery shall use all reasonable endeavours to provide a high standard of service, care and treatment to all Animals and their Owners. In the event that the Owner is not satisfied complaints should be directed to the Practice Manager.
5.1 The Owner’s rights as a consumer under consumer protection legislation from time to time in force shall not be affected by these Terms and Conditions.
5.2 The Surgery may, from time to time, change these Terms and Conditions. Details of any such changes will be displayed at the Surgery and posted on the Surgery website.
- No Waiver
No failure by the Surgery to enforce any provision in these Terms and Conditions shall constitute a waiver of the right to subsequently enforce that provision or any other provision of these Terms and Conditions. Such failure shall not be deemed to be a waiver of any preceding or subsequent breach or a continuing waiver.
If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected.
- Law and Jurisdiction
8.1 These Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales.
8.2 Any dispute, controversy, proceedings or claim between the parties relating to these Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
